Terms of Service
The rules for using Fairway VS, in plain language.

These terms are an agreement between you and Fairway VS LLC (“Fairway VS,” “we,” “us”). They cover the Fairway VS app and the website at fairwayvs.com (together, the “Service”). By using the Service, you agree to these terms. If you don't agree, don't use the Service.
Eligibility
You must be at least 13 years old to use the Service. You must be at least 18 years old to buy a trip pass.
Your account
Give accurate information when you create an account and keep it up to date. Keep your sign-in secure. You are responsible for activity under your account, so tell us at support@fairwayvs.com if you think someone else is using it.
You can delete your account at any time. The steps are on the delete your account page.
Leagues and organizers
A league is created and run by its organizers. Organizers decide who joins, assign roles such as captain and spectator, set up trips, and may remove members. They are responsible for their leagues and trips.
Organizers can see members' contact details so they can run the league, and may use those details only for league purposes.
What you add to a league, such as scores, results, RSVPs, and votes, is visible to that league's members.
Trip passes and payment
Players, captains, and spectators use the Service free. An organizer can buy a trip pass, which unlocks the captain draft, the matchup draft, and live scoring for one trip.
A trip pass is priced per golf day for the group size you choose, and the price is shown before you pay. Prices are in US dollars. We may change prices for future purchases; changes don't affect passes you've already bought.
Payments are processed by Stripe and are also subject to Stripe's terms. We don't receive or store full card numbers.
Refunds
Refunds follow our refund policy. In short: you get a full refund if you ask before the trip's first golf day starts. After that, passes are non-refundable except where the law requires a refund or when a problem on our side kept you from using the pass.
Your content
You keep ownership of what you add to the Service, including scores, posts, polls and votes, and your profile details (“your content”).
You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, display, and share your content as needed to run the Service, for example to show your scores to your league. This license ends when your content is deleted, except for content that remains part of a league's records, such as your name on past results, which other members rely on.
You are responsible for your content and confirm you have the right to post it. We may remove content that breaks these terms.
The settle-up ledger
The settle-up ledger lets league members record who owes whom. It records IOUs only. No money moves through the Service. We don't process, collect, or guarantee any payment between members, and we are not a party to any debt recorded in the ledger.
Wagering
Fairway VS doesn't take, place, or process bets. If your group plays for money, you are responsible for complying with the laws on wagering where you live and play.
Acceptable use
When you use the Service, don't:
- Break the law, or help anyone else break it
- Harass, threaten, or impersonate anyone
- Post content that is illegal or hateful, or that infringes someone else's rights
- Access accounts or league data you aren't authorized to see
- Interfere with, overload, or try to get around the security of the Service
- Scrape the Service or access it with automated tools without our permission
- Copy, modify, or reverse engineer the app, except where the law allows it
Good-faith security research that follows our security policy is welcome.
Suspension and termination
You can stop using the Service and delete your account at any time.
We may suspend or end your access if you break these terms, if the law requires it, or to protect the Service or other users. If we end your access because you broke these terms, you are not entitled to a refund except where the law requires one.
The sections on your content, the settle-up ledger, wagering, disclaimers, limitation of liability, and governing law continue to apply after your access ends.
Apple and other providers
The Service relies on third parties such as Apple, Google, and Stripe, whose own terms also apply when you use their services.
If you downloaded the app from Apple's App Store:
- These terms are between you and Fairway VS LLC, not Apple.
- Apple has no obligation to provide maintenance or support for the app.
- To the extent the law allows, Apple has no warranty obligation for the app, and Apple is not responsible for addressing claims about the app, including product liability, legal compliance, or intellectual property claims.
- You confirm you are not located in a country subject to a U.S. government embargo and are not on a U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise that the Service will be uninterrupted or error-free.
Scores, handicap strokes, results, and stats come from information users enter, so check anything that matters to you. Fairway VS is not an official handicap service.
Limitation of liability
To the fullest extent the law allows:
- Fairway VS LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service.
- Our total liability for any claim related to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and US$50.
Some places don't allow these limits, so they may not all apply to you.
Governing law
These terms are governed by the laws of the state in which Fairway VS LLC is organized, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in that state, unless the law where you live requires otherwise.
Changes to these terms
We may update these terms. We'll post the new version on this page and change the date at the top, and we'll tell you in the app about material changes. If you keep using the Service after the changes take effect, you accept the updated terms.
